Attic intruder enters into plea agreement

A rural Gering man found crawling in his neighbor’s garage attic in July has agreed to plea to three misdemeanor charges. Court documents say 37 year old Davin Rose entered a no contest or guilty plea  Friday to attempted possession of methamphetamine, attempted possession of a narcotic and criminal mischief

Court documents indicated  deputies were dispatched to a home in the early morning hours on Pinecone Drive after the homeowner called the Comm Center to let them know that he had an intruder being held at gunpoint.

Court documents say that Rose was crawling in his neighbors garage attic. The homeowner says he heard his dogs barking, and went out and saw Rose. When deputies arrived, they used pepper spray in the attic area to get him to come down. As they took him down from the attic, deputies took a gun from Rose’s holster- at which time he began to passively resist arrest.

Sentencing will be done at a later date by Scotts Bluff County District Judge Leo Dobrovolny.
