Nelson: Supreme Court decision could result in single-payer health care

Senator Ben Nelson said Wednesday that a likely U.S. Supreme Court decision striking down the individual mandate from the national health care law would likely pave the way to a single-payer system, or back to the dysfunctional system America had prior to health care reform.

Nelson says those pushing for health care reform to be ruled unconstitutional will not like what they get if that is indeed the ruling.

Nelson says a survey conducted by Bloomberg News indicates most legal scholars believe that the heart of the health care law, the individual mandate, is constitutional and should be upheld by the Supreme Court. But he adds only a minority of legal scholars believe that the court will actually uphold the individual mandate on Thursday.

Nelson says twenty Republican senators pushed for the individual mandate in the 1990s and it was a key part of the Massachusetts health reform legislation that then-Governor Mitt Romney signed into law in the mid-1990s.
