Sidney man no longer faces death penalty
Cheyenne County Attorney Paul Schaub has dropped his request for the death penalty in amended first degree murder charges filed Thursday against 53 year old Larry Martinez of Sidney. Martinez is accused in the July 15th, 2012 shooting of 30-year-old Mandy Kershman of Sidney.
Schaub said after a "review of additional facts in the case, further legal research, and after consulting with several attorneys experienced in prosecuting death penalty cases he is no longer convinced there is sufficient evidence to support the death penalty."
Arraignment on the newly amended charges has been scheduled for February 12th at 8:30 a.m. Martinez is also charged with use of a firearm to commit a felony.
Court documents say Martinez told investigators he shot Kershman because of a text message from her that made him mad.
